WORKERS’ COMP SURVEILLANCE

For insurance companies, surveillance is often used to dispute the alleged restrictions and limitations of a person claiming disability. Insurance companies are entitled to evaluate the validity of the information submitted in the disability claim forms. Insurance adjusters do this by requesting surveillance from an investigation agency. The Claimant is shadowed in public to determine any inconsistencies between the restrictions/limitations the Claimant and their doctor have reported regarding bending, lifting, carrying, standing, walking, carrying, and climbing.

Workers’ Comp surveillance is by far the most effective tool insurance companies use to mitigate the loss and exposure on even the toughest claims. Surveillance is one of the most common methods that private investigators use to document evidence on the Claimant’s level of activity and range of motion. A physician with review the surveillance video and determine if the Claimant is operating out of their prescribed restrictions.
When an investigator is able to capture video evidence of the claimant performing activities outside the scope of their physical restrictions set by their physician, the subject matter must be reviewed by their doctor. If the activities are, in fact, deemed outside the scope of their prescribed physical restrictions, the video may provide evidence that weakens or even stops payments of the workers’ compensation benefits.
